This site may be used for lawful purposes only. The user agrees to indemnify and hold harmless Spectrum Hosting, it's owners and partners from any claims resulting from the use of this website that damages the user or any other party.

Visitors to our site have the option to provide or not to provide any information. We do not require any login for viewing our site. If you elect not to provide information when inquiring about our services, we do not take any actions to obtain information from or about you.

Any information you submit for an order or a request for further information about our services is used solely for the purposes it was intended.

For each visitor to our website, our webserver automatically tracks page views to generate a domain report, referrer report, browser report, and operating system report. We use these reports to aggregate information on what pages are being accessed.

We do not capture email addresses. If you volunteer your email address, it will only be used to communicate with you. We will never share your email address with others. If you are ordering Hosting please read the website content guidelines and disclaimer below.

Hosting Payments and Special Services Payments

All services including; Hosting, Web Design, Custom Development, and Maintenance of website services, must be paid for in advance. Payments are processed through 2checkout.

All payments processed through 2CheckOut require that you enter a credit card or a checking account number. Your credit card or bank account is then billed for monthly payments. You will be billed a $45 NSF charge for Non Sufficient Funds on your due date. NSF charges must be paid within 10 days to avoid termination of your account.

We do not charge a hosting set up fee. We charge an installation fee for setting up shopping carts, databases, applications and scripts, etc., and a design fee and maintenance fee for other services. Our base (non custom) service rates are $125 per hour.

UPGRADING:
You are welcome to upgrade your account as your business grows. Please contact customer service for all upgrades, special requests and installations.

LATE CHARGE PENALTIES / TERMINATION:

If processing your payment fails on your due date you will be charged a $45 late fee. You will then have 10 days to bring your account current to avoid termination. Your account will be suspended for non payment 3 days after you have been notified of payment failure and a warning notice will appear on your homepage.

If your account is suspended you will be charged a $30 reconnection fee.

If it becomes necessary to terminate your account due to non-payment, be advised that termination will immediately erase all your site files from our server. These files will be gone and unretrievable.

We do not issue refunds for cancelations or termination. No refunds are issued for annual payments. With your annual payment discount you were given a choice that specifically stated we do not give refunds if you pay for a whole year in advance.

Web Site Content

Transmission, storage or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to, copyrighted material, threatening or obscene or material protected by trade secret or other statute. The account user agrees to indemnify and hold harmless Spectrum Hosting from any claims resulting from the use of a service that damages you or any other party.

All pornographic content and sex-related merchandising is prohibited on all Spectrum Hosting servers. This includes sites that may infer sexual content or links to adult content elsewhere.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to Spectrum Hosting servers or any other server on the internet. Links to such materials are also prohibited.

Examples of unacceptable content or links

• Pirated software
• Hacker programs or archives
• Warez sites

Commercial Advertising – E-mail

Spamming, or the sending of unsolicited e-mail, from a Spectrum Hosting server or using an e-mail address or domain that is maintained on a Spectrum Hosting machine as referrence is STRICTLY prohibited. Spectrum Hosting will be the sole arbiter as to what constitutes a violation of this provision.

Server Abuse

Any attempt to undermine or cause harm to a server or customer of Spectrum Hosting is strictly prohibited.

Refusal of Service

We reserve the right to refuse, cancel or suspend service at our sole discretion.

Failure to follow any term or condition will be grounds for immediate account deactivation (termination) if you are hosting your site with us.

Spectrum Hosting provides virtual web hosting solutions to our clients. Should servers ever be down, we will do everything in our power to get them back up as soon as possible, however, we shall not be held liable for any downtime you may experience or technical problems that are not within our immediate control.

DISCLAIMER OF WARRANTY
THE SERVICES, THE SPECTRUM HOSTING ONLINE SITE, INCLUDING WITHOUT LIMITATION, ALL PRODUCTS AND SERVICES DISPLAYED OR OFFERED ON THE SPECTRUM HOSTING ONLINE SITE, AND ALL TEXT, GRAPHICS, LINKS AND APPLICATIONS ARE PROVIDED TO CLIENT ON AN 'AS IS' BASIS AND WITHOUT WARRANTY OF ANY KIND. SPECTRUM HOSTING DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO EACH OF THE FOREGOING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR ARISING FROM A COURSE OF DEALING. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SPECTRUM HOSTING SPECIFICALLY DISCLAIMS ANY WARRANTY THAT (1)THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE; (2) DEFECTS WILL BE CORRECTED; (3) THERE ARE NO VIRUSES OR OTHER HARMFUL COMPONENTS; AND (4) THE SECURITY METHODS EMPLOYED WILL BE SUFFICIENT.

LIMITATION OF LIABILITY

IN NO EVENT SHALL SPECTRUM HOSTING BE LIABLE FOR DAMAGES RESULTING FROM LOSS OF DATA, PROFITS, USE OF THE SPECTRUM HOSTING ONLINE SITE OR ANY SPECTRUM HOSTING, or PARTNER PRODUCTS OR SERVICES, OR FOR ANY INCIDENTAL, INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH THIS AGREEMENT OR IN CONNECTION WITH ANY PRODUCTS OR SERVICES PROVIDED HEREUNDER. IN NO EVENT SHALL SPECTRUM HOSTING CUMULATIVE LIABILITY EXCEED AN AMOUNT GREATER THAN FIVE HUNDRED DOLLARS ($500 US).
